These Terms of Service govern your use of Shady Acres Landscape's services and website. By engaging our services or accessing shadyacreslandscape.com, you agree to these terms. Please review them carefully before proceeding with any landscape project or website interaction.

Service Agreements

All landscape services provided by Shady Acres Landscape are governed by written service agreements. These documents specify project scope, materials, timelines, payment terms, and warranty provisions. Verbal agreements or understandings not documented in the service agreement are not binding. Clients must review and sign agreements before work commences.

Estimate Process

Estimates provided by Shady Acres Landscape are based on site assessments and current material pricing. Estimates are valid for 30 days from issue date. Final pricing may adjust if site conditions differ from initial assessment or if client requests scope changes. Detailed change orders document any modifications to original estimates.

Payment Terms

Payment schedules are outlined in service agreements. Typically, a deposit is required to schedule work, with progress payments due at specified milestones. Final payment is due upon project completion and client walkthrough. Late payments may incur finance charges and could delay ongoing or future services.

Property Access

Clients must provide safe, unobstructed access to work areas. This includes securing pets, removing vehicles from driveways, and identifying underground utilities. Failure to provide access may result in rescheduling fees. Shady Acres Landscape is not responsible for damage to unmarked utilities or obstacles not disclosed before work begins.

Warranty Provisions

Shady Acres Landscape provides warranties for installed materials and workmanship as specified in service agreements. Plant materials carry separate warranties from suppliers. Warranty claims must be submitted in writing with supporting documentation. Warranties do not cover damage from neglect, improper maintenance, weather events, or unauthorized alterations.

Liability Limitations

Shady Acres Landscape's liability is limited to the contract value of services provided. We are not liable for consequential damages, including loss of use or incidental expenses. Our insurance covers workplace incidents, but clients should maintain appropriate property insurance. Dispute resolution begins with mediation before any legal proceedings.

Intellectual Property

Landscape designs, plans, and specifications created by Shady Acres Landscape remain our intellectual property. Clients receive licenses to use these materials for their properties but cannot reproduce or transfer designs without written permission. We may use completed project photographs for promotional purposes unless clients opt out in writing.

Website Use

Content on shadyacreslandscape.com is for informational purposes only. While we strive for accuracy, we do not guarantee completeness or timeliness of information. Website users agree not to copy, distribute, or misuse content. Unauthorized access attempts or interference with website functionality are prohibited.

Communication Policies

Electronic communications, including emails and text messages, are considered valid forms of notice. Clients should maintain current contact information in our records. Service updates, billing notices, and important announcements will be sent via documented channels. Responses to inquiries are typically provided within two business days.

Termination Rights

Either party may terminate service agreements with written notice under conditions specified in the agreement. Termination may involve cancellation fees for work in progress and costs for materials ordered. Upon termination, Shady Acres Landscape will provide documentation of completed work and return any prepaid amounts for unperformed services.

Governing Law

These Terms of Service are governed by the laws of the state where Shady Acres Landscape is headquartered. Any legal actions must be filed in the appropriate courts within that jurisdiction. If any provision is found unenforceable, remaining terms remain in effect. These terms constitute the entire agreement between parties regarding the subject matter.
